The Law and You

Some producers of clinical or hazardous waste are exempt from the rules and regulations but if you or your organisation generates over 500kg of clinical or hazardous waste in a year, you’ll need to register with the Environment Agency, each year, as a producer of hazardous waste.

binRegistering with the Environment Agency means you’ll receive a unique registration number. Among other things, you’ll need to quote this on the paperwork relating to your clinical/ hazardous waste. If you don’t have an Environment Agency registration number and your organisation isn’t exempt under the legislation, your waste can’t – legally - be collected.

The law states that, as a waste generator, you have to ensure that your waste is being disposed of legally. Using a professional, competent and Environment Agency-licenced specialist waste management company, such as Waste King, will ensure that you receive all the appropriate documentation – including Duty of Care certification - so that you can prove that your organisation complies with all the relevant legislation.

Following the introduction of the Landfill Directive and Hazardous Waste Regulations 2005, each type of waste - especially clinical/hazardous waste - must be disposed of in the appropriate manner for each type of waste. The three disposal methods available are: incineration; landfill, or recycled/ treated.

This means that the waste you generate must be put in the appropriate container. These are likely to be colour-coded but they should also have an appropriate European Waste Catalogue(EWC) code printed on them. This code should also appear on the consignment note that accompanies the waste shipment.

So, for every clinical/hazardous waste collection, you should receive a consignment note, containing your Environment Agency registration number. It should also detail the type of waste; its EWC code; the quantity collected; the waste’s components; the hazard code, and container type.
